AltNews Co-founder Zubair Arrested Over 2018 Tweet Allegedly Hurting Religious Sentiments

New Delhi: Alt News co-founder Mohammed Zubair was arrested on Monday by the Delhi Police for allegedly hurting religious sentiments with a tweet from 2018.

His arrest came after a Twitter handle tagged the Delhi Police a week prior about Zubair’s tweet concerning a Hindu mythological figure.

Context of the Arrest

According to Delhi Police sources, Zubair was taken into custody after the department registered a case based on the complaint received through Twitter. The tweet in question allegedly contained an image meant to insult a deity of a particular religion, as highlighted by DCP KPS Malhotra.

Malhotra stated, “Such tweets were getting retweeted and it appeared that there is a brigade of social media entities who indulge in insult mongering thereby leading to a possible ramification on communal harmony.” Zubair was to be presented before a magistrate for further police custody to aid the investigation.

Legal Background

Zubair is facing charges under several sections of the Indian Penal Code. Specifically, he has been booked under IPC Section 153A, which addresses promoting enmity between different groups on various grounds, including religion, and Section 295A, which pertains to deliberate and malicious acts intended to outrage religious feelings.

In June, a Twitter handle reported Zubair’s earlier tweet, which they deemed objectionable. Malhotra further noted that the nature of the investigation revealed evasiveness on Zubair’s part, as he did not provide necessary technical equipment or cooperate fully with the inquiry.

Previous Legal Issues

This is not Zubair’s first brush with the law. He was previously called in for questioning related to a 2020 case. During that investigation, Zubair’s earlier tweet was not deemed objectionable. However, subsequent posts led to accusations of derogatory remarks which drew attention from the authorities. Notably, he was booked under sections of the POCSO Act in the 2020 case, though he was granted interim protection from arrest.

After the backlash surrounding various tweets, including those about controversial remarks made by former BJP spokesperson Nupur Sharma on the Prophet Muhammad, Zubair deactivated his Facebook account in June, reflecting the significant pressures he faces in today’s politically charged environment.

Why This Matters

The arrest of Mohammed Zubair highlights ongoing tensions in India’s political landscape, where discussions about religious sentiments can provoke serious legal repercussions. His case raises questions about freedom of speech, the role of social media in public discourse, and the delicate balance between maintaining communal harmony and allowing for dissenting or critical voices in a democracy.

This incident is indicative of broader patterns of policing speech in India, especially when it intersects with communal issues. It also underscores the polarized nature of social media discourse in the country, where stakes are high, and the cost of voicing dissent can be significant.
