Suspended Advocate Justifies Assault Attempt on CJI BR Gavai

In a troubling incident within the Supreme Court, suspended advocate Rakesh Kishore attempted to attack Chief Justice of India (CJI) BR Gavai. Kishore defended his actions, claiming the CJI’s remarks regarding the “bulldozer raj” were misguided and suggested he may strike again.

During an interview with ANI, Kishore stated, “CJI should understand that when he is sitting on such a high constitutional post, he must know the meaning of ‘Milord’ and uphold its dignity. You go to Mauritius and say that the country will not run with a bulldozer.” His comments were tied to a speech given by CJI Gavai in Mauritius, where he emphasized, “India’s legal system operates under the rule of law, not under the rule of bulldozer.”

Kishore continued to justify the controversial actions taken by Uttar Pradesh Chief Minister Yogi Adityanath, stating, “I ask the CJI and those opposing me, is the bulldozer action by Yogi ji against those who encroached on government property wrong? I am hurt and will continue to be so.”

The incident escalated on Monday when Kishore, aged 72, attempted to throw a shoe at CJI Gavai during court proceedings. Following the attempt, he shouted, “India will not tolerate the insult of Sanatan Dharma,” before being promptly removed by security personnel.

Kishore was subsequently taken into custody by the Delhi Police but was later released after the Supreme Court registry opted not to file charges. In police questioning, he displayed no remorse for his actions and cited a recent Supreme Court judgment as a rationale for his attack.

The case in question involved a plea for the reconstruction and reinstallation of an idol at the Javari Temple, which the CJI-led bench declined to hear, referring it to the Archaeological Survey of India and advising the petitioner to “ask the deity to do something.” Kishore remarked, “I couldn’t sleep after that judgment,” emphasizing that he felt compelled to act in response to what he perceived as an insult.

This incident has raised concerns over judicial decorum and the increasing intensity of politically motivated actions within the judicial system.
