After more than 17 years, the Orissa High Court has overturned the life sentence of a 42-year-old woman, Laulina Achariya, who confessed to killing her husband, Surendra Bag, when she was 25 years old. The court stated that the trial court’s verdict was based on “surmises and conjectures” and was a “miscarriage of justice”.

In 2007, Laulina walked into a police station in Sundargarh district and admitted to murdering her husband. Police found Surendra’s body in their home with blood everywhere and an axe nearby. Laulina was sentenced to life in prison in 2009, but she challenged the decision in the High Court.

The division bench of justices Debabrata Dash and V Narasingh acquitted Laulina, noting that the conviction was not based on a proper analysis of the evidence. The court highlighted that there were no eyewitnesses to the crime and the prosecution failed to establish the “last seen theory” beyond a reasonable doubt.

This case serves as a stark example of a miscarriage of justice where the accused was wrongly convicted based on insufficient evidence.
