The rise of finfluencers in India’s financial landscape presents significant challenges regarding transparency and regulatory oversight. Despite recent regulatory actions by SEBI, many finfluencers continue to operate in a grey area, often providing explicit stock recommendations without proper disclosures, raising concerns about investor protection.

Surge in Finfluencer Influence

Recent data from a CFA Institute study indicates that the percentage of SEBI-registered finfluencers has increased from 2% to 6.3% over the last year. This rise highlights a growing recognition of the need for regulatory oversight in the burgeoning finfluencer market, which encompasses social media platforms like Instagram, YouTube, LinkedIn, and X (formerly Twitter). However, the same report reveals that approximately 33.3% of these influencers continue to offer explicit stock recommendations, a figure consistent with past reports, raising questions about accountability.

Challenges in Regulatory Enforcement

Despite SEBI’s attempts to impose stricter regulations, compliance remains low among finfluencers. A concerning 37.5% fail to disclose conflicts of interest, and around 27% do not mention crucial investment details such as fees, tax implications, or lock-in periods to their audience. Moreover, findings show that 6% of sampled creators have faced issues related to misconduct, and 4% have already incurred penalties from SEBI. Akshaya Bhansali, Managing Partner at Mindspright Legal, expressed that while SEBI’s enforcement actions have deterred some unregistered players, many have simply shifted their activities to private channels like WhatsApp and Telegram, making them harder to track and regulate.

The Shift to Private Channels

The migration of investment discussions to private groups and webinars is alarming. This movement away from public platforms diminishes regulatory visibility, intensifying worries about misleading financial advice. Ongoing issues include inadequately disclosed paid collaborations and opaque financial incentives that may mislead potential investors. Bhansali emphasized the inherent difficulties of regulating financial content at scale, particularly as traditional monitoring fails to cover these private, unmonitored spaces.

As these influencers gain more traction and authority through vast social media followings—Instagram alone accounts for nearly half of the total followers of the analyzed creators—the importance of investor education and awareness campaigns becomes paramount. For Indian investors, the need to exercise caution and seek clarity on the disclosures provided by finfluencers is critical, especially in an environment where misinformation can spread quickly and without scrutiny.
