The Supreme Court has denied bail to activists Umar Khalid and Sharjeel Imam in connection with a larger conspiracy case related to the Delhi pogrom. In contrast, bail was granted to their co-accused—Gulfisha Fatima, Meeran Haider, Shifa Ur Rehman, Mohd. Saleem Khan, and Shadab Ahmad—after the court cited differences in their roles and circumstances.

The court stated that sufficient material existed to establish a prima facie case against Khalid and Imam under the Unlawful Activities (Prevention) Act, 1967.

“The grant of bail to these accused does not indicate a weakening of the allegations against them. They will be released on bail subject to certain conditions, totaling approximately 12. Should these conditions be breached, the trial court may revoke bail after hearing from the accused,” read the judgment delivered by Justices Aravind Kumar.

This decision highlights the ongoing legal scrutiny surrounding the case and the differing assessments of culpability among the accused.
