The body of six-year-old Hind Rajab, along with five members of her family, was discovered after their vehicle was besieged by Israeli tanks for nearly 12 days in the Tal Al-Hawa area, southwest of Gaza City.
On February 28, 2024, the Hind Rajab Foundation (HRF) submitted a 120-page legal document to the International Criminal Court (ICC), naming 24 Israeli soldiers and commanders allegedly implicated in the deaths of Hind Rajab and her family, as well as rescuers. This filing followed the airing of a documentary by Al Jazeera Arabic that exposed new details surrounding the incident.
Filed under Article 15, the communication accuses individuals from Israel’s 401st Armoured Brigade, particularly the Vampire Empire Company of the 52nd Armoured Battalion, of deliberately targeting civilians in Gaza City on January 29, 2024.
The documentary, titled Ma Khafiya Aatham (Tip of the Iceberg), revealed previously undisclosed information about the circumstances of the Rajab family’s killing. The HRF reported that the attack resulted in the deaths of Hind Rajab, six relatives, and two Palestinian Red Crescent paramedics, Yusuf al-Zeino and Ahmed al-Madhoun, who were trying to assist them. The foundation claims it possesses digital, satellite, and forensic evidence demonstrating that Israeli Merkava IV tanks repeatedly fired upon the family’s black Kia Picanto and later targeted the ambulance sent for aid.
The filing identifies senior officers such as Colonel Beni Aharon, commander of the 401st Armoured Brigade; Lieutenant Colonel Daniel Ella, commander of the 52nd Armoured Battalion; and Major Sean Glass, commander of the Vampire Empire Company. Names of 22 other crew members have been submitted confidentially to the ICC and will be disclosed progressively as legal actions initiate in other jurisdictions.
The HRF stated, “The attacks were carried out with full knowledge of the victims’ civilian and protected status,” characterizing the actions as war crimes, crimes against humanity, and genocide under the Rome Statute.
The foundation is pursuing additional prosecutions under universal jurisdiction and dual nationality laws against alleged perpetrators with foreign citizenship in addition to Israeli nationality. A case has already been initiated in Argentina against one of the soldiers named, Itay Cukierkopf, while more cases are being prepared across Europe, Latin America, and North America.
“This is not only a legal act — it’s a revolt against the global order of impunity,” remarked Dyab Abou Jahjah, HRF’s general director. He emphasized the foundation’s commitment to holding accountable those involved in Hind’s murder. Natacha Bracq, HRF’s head of litigation, stated that the filing establishes “a direct chain of command, operational control, and deliberate intent,” asserting that the evidence satisfies the legal criteria for prosecution under international criminal law.
The HRF has urged the ICC prosecutor’s office to include these killings in its ongoing investigation into the Situation in the State of Palestine and to issue arrest warrants for the 24 individuals named.
