A special National Investigation Agency (NIA) court in Srinagar has issued a proclamation mandating the appearance of three individuals from Kashmir, currently residing in the US and Germany, by the end of January. The Jammu and Kashmir Police have charged them with allegedly “weaponising” social media platforms to instigate street violence, disrupt public life, damage property, disturb public order, and fuel mass unrest.
The individuals identified include Mubeen Ahmad Shah and Azizul Hassan Ashai, also known as Tony Ashai, both originally from Srinagar, and Rifat Wani from Kupwara. According to the Counter Intelligence Kashmir (CIK), the intelligence arm of the Jammu and Kashmir Police, Shah and Ashai are based in the United States, while Wani resides in Germany.
In an official statement, the CIK revealed that the Special Judge designated under the NIA Act in Srinagar has issued this proclamation under Section 82 of the Code of Criminal Procedure, 1973. The case is based on allegations of anti-national propaganda and involves charges under sections 153-A and 505 of the Indian Penal Code, as well as section 13 of the Unlawful Activities (Prevention) Act. These charges stem from “credible intelligence inputs” indicating a “well-orchestrated conspiracy” orchestrated by elements acting on behalf of secessionist forces both within Kashmir and abroad.
The CIK further explained that these individuals were posing as news portals, journalists, and freelancers while allegedly weaponising social media platforms, such as Facebook, X (formerly Twitter), and WhatsApp, to generate and disseminate false, exaggerated, and secessionist content.
Police in Jammu and Kashmir stated that the deliberate aim of this “digital misinformation campaign” was to incite violence, disrupt daily life, damage property, disturb public order, and foster anti-national sentiments in pursuit of a secessionist agenda aimed at creating disaffection towards the Union of India.
Despite being labelled as absconders, the accused are reported to be actively engaged in hostile activities on social media, where they continue to share false and provocative content aimed at inciting large-scale unrest and destabilizing public order in Jammu and Kashmir.
