Four of the five anti-Citizenship Amendment Act (CAA) activists and human rights defenders granted bail by the Supreme Court of India two days ago were released from Tihar Jail on Wednesday night. They had spent over 2,000 days in custody as undertrial prisoners in connection with the Delhi violence conspiracy case, which involves allegations under the Unlawful Activities (Prevention) Act (UAPA).
Gulfisha Fatima, Shifa Ur Rehman, Mohd Saleem Khan, and Meeran Haider were freed shortly after a Delhi court confirmed their release orders, following the Supreme Court’s bail ruling. The release came after the trial court verified that all bail conditions set by the apex court had been met.
Earlier on Wednesday, the court issued release orders for the four activists after they provided bail bonds of ₹2 lakh each, along with two local sureties. The fifth activist granted bail, Shadab Ahmed, remains in custody as he did not appear before the trial court to complete the bail bond process.
During the hearing on Monday, the Supreme Court denied bail to Umar Khalid and Sharjeel Imam, two key figures in the anti-CAA movement, citing sufficient grounds for a prima facie case against them under the UAPA. However, bail was granted to the five other accused, with the court noting differences in the levels of involvement in the alleged conspiracy.
The release of the four activists was celebrated by their families and supporters, although it was also met with sorrow and frustration over the continued detention of Khalid, Imam, and others who have been imprisoned for over five years related to the same case.
This report covers the major developments concerning the release of anti-CAA activists and the ongoing legal struggles faced by others involved in the case.
